General
Please read these Terms and Conditions (“Terms”) carefully before using the Mind Parent app and services (the “Service”) operated by Mind Parent (“us”, “we”, or “our”). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
The Service is intended for users who are at least 16 years old. If you are under the age of 16, you may not use the Service without the involvement of a parent or guardian.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.
Content
Our Service allows you to post, link, store, share, and otherwise use certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain all rights to the Content you submit, post, or display and are responsible for protecting those rights.
You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy, publicity, copyrights, contract, or any other rights of any person.
Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms and may result in immediate termination of your account.
You are responsible for safeguarding your password and for any activities or actions under your password, whether it is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any security breach or unauthorized use of your account.
Intellectual Property
The original content of the Service, including but not limited to text, trademarks, graphics, logos, icons, images, software, and overall compilation, is the property of Mind Parent, its licensors, or suppliers (“Intellectual Property”) and is protected by applicable copyright and intellectual property laws. You agree not to remove or alter any copyright or proprietary notices in such materials.
Ownership of all user-generated Content belongs to you or the third party that holds intellectual property rights to such material. You grant us a worldwide, perpetual, non-exclusive, royalty-free, and transferable right to use, process, store, display, distribute, stream, and reproduce such Content in connection with providing the Service and related products.
You warrant that you hold all necessary rights to upload and use Content and to grant us the license described above.
Links to Other Web Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by Mind Parent.
We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Mind Parent shall not be responsible or liable for any damage or loss caused by or in connection with use of or reliance on any such content, goods, or services.
We strongly recommend reviewing the terms and privacy policies of any third-party websites or services you visit.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease.
If you wish to terminate your account, you may stop using the Service. To request removal from our database, email us at support@mindparent.app. We will take reasonable steps to verify your identity before processing the request.
To cancel a personal subscription, please use the appropriate steps in the App Store, Google Play, or other relevant app stores (“App Stores”). We are not responsible for subscription issues arising from App Stores, including billing or cancellation errors.
Network Access
You are solely responsible for securing the necessary network access to use the Service. Standard data charges may apply from your internet or mobile provider. You are also responsible for obtaining and updating the hardware and software necessary to access the Service.
Personal Information
We process personal data in connection with your use of the Service. This is governed by our Privacy Policy, available at https://mindparent.app/privacy-policy.
Commitments in Relation to Apple and Google
The App is licensed, not sold. Mind Parent, its licensors, and/or suppliers retain ownership of the App and all rights therein. Standard mobile data charges may apply. Apple Inc. and Google LLC are not responsible for the App, and are not parties to this agreement.
Limitation of Liability
In no event shall Mind Parent or its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained through the Service; and (iv) unauthorized access or alteration of your transmissions or content, regardless of the legal theory and even if we were advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless Mind Parent and its affiliates from any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney’s fees) resulting from your violation of these Terms or any applicable laws.
If any Content you submit infringes the intellectual property rights of a third party, you agree to promptly remove such content and hold us harmless from any claims or damages arising from such infringement.
Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. Use of the Service is at your own risk. We make no warranties regarding the availability, performance, reliability, or accuracy of the Service.
We do not warrant that: (i) the Service will function uninterrupted or error-free; (ii) any defects will be corrected; (iii) the Service is free of harmful components; or (iv) the results of using the Service will meet your expectations.
Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law provisions. Our failure to enforce any right or provision will not be deemed a waiver. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
Changes
We reserve the right to modify these Terms at any time. The current version will be available at https://mindparent.app/terms-of-use. If material changes require your consent under data protection laws, we will notify you accordingly and seek your consent where necessary.
By continuing to access or use the Service after any revisions take effect, you agree to be bound by the updated Terms. If you do not agree, please stop using the Service.
